Better than Model-Match: Model-Load

Postby RCModelReviews » Tue May 04, 2010 6:49 am

What do you think of my Model Load idea?

Better than model-match?

Since it can't now be patented, do you think/hope that manufacturers will run with it and make our flying a whole lot safer and more convenient?

Any suggestions as to how it could be improved or what flaws there might be with this concept?

Heya, this is Toumal from the FG forums!

I think your idea is quite awesome. I dunno what would happen if you have multiple receivers turned on, but I guess that could still be handled in a certain way.
However, just because you posted that article online doesn't mean it can't be patented. "Prior art" only matters in countries where such a thing can invalidate a patent. In most parts of europe, the system is "First to Patent", not "First to Invent" as in the US.

To be sure you'd have to patent it yourself - which is of course going full circle and reaffirming what many people already know and hate about the patent system as a whole to be true.

Worse, even individual aspects of your "Model Load" idea might already be covered by individual claims in the Spektrum patent, like for example the general principle of associating a receiver with a certain model. Since one patent often contains multiple "claims", this can also be a problem for anyone wanting to implement "Model Load".

Just like the mpeg consortium (owners of the h.264 codec) are going to go after the open codecs like Theora, Spektrum could still go after any implementation of "Model Load" by saying that it infringes on their patent.

The multiple receiver situation is pretty easy -- the transmitter would just warn that there was more than one receiver turned on and request a response from the user: retain the original model memory (thus allowing for large models with multiple receivers) switch to the new model memory, or wait until one of the receivers was turned off and then select the memory associated with the one that's still on.

As for patent law -- yes it's a mess but, given that the largest single market is the USA, the prior art is a useful protection against such an idea being hijacked and held to commercial ransom.

BTW posting a potentially patentable idea on a forum most certainly would invalidate the opportunity for patenting in Europe as it would constitute disclosure.
Patenting is a minefield for the lay-person and IMHO unless you get (an expensive) lawyer involved you are very unlikely to end up with a series of legal claims that would stand up in court.
